Terms of Service

1. Account Registration and Security

To access most features of KithBox, you must register for an account. You agree to provide accurate and complete information during registration and keep it up to date.

• You are solely responsible for maintaining the confidentiality of your account credentials, passwords, and security keys (including configured passkeys and two-factor authentication).
• You agree to accept responsibility for all activities that occur under your account.
• If you believe your account has been compromised, you must immediately notify your album administrator or update your password and security settings.

2. User Content & Media Ownership

KithBox is a private, family-centric gallery where you can upload family photographs, videos, descriptions, comments, and other media (collectively, "User Content").

• Ownership: You retain full ownership, copyright, and all other rights to the User Content you upload or post to KithBox.
• License to KithBox: You grant KithBox a non-exclusive, royalty-free, worldwide, limited license strictly to store, host, process, and display your User Content for the sole purpose of providing the Service to you and the specific family members you explicitly invite. We will never use or sell your family's media for marketing, machine-learning training, or advertising.
• Content Responsibility: You are solely responsible for all User Content uploaded through your account. You agree that you will not upload any content that is unlawful, harmful, offensive, or violates the intellectual property rights of others.

3. Sharing and Invitations

KithBox offers private sharing controls enabling album owners to invite family members and collaborators with specific roles:

• Viewers have read-only access to view and interact with comments or likes.
• Editors have permission to upload photos and videos, which may be subject to moderation approval by the album owner based on the owner's chosen settings.
• You represent and warrant that you have obtained any necessary consent from family members, especially minors, before uploading their likeness or contact details.

4. Subscriptions, Fees, and Quotas

Some features of the Service are subject to paid subscriptions, which are processed securely via Stripe:

• Quotas: Account limits (including photo and video upload quotas) are enforced based on your subscription tier (Free, Family Pro, or Legacy).
• Billing: You agree to pay all fees associated with your selected tier. Subscriptions are billed on a recurring basis and can be managed or canceled at any time through the Billing Portal.
• Exceeding Quotas: If you reach or exceed your subscription tier's storage limits, your ability to upload new media may be temporarily suspended until you upgrade your subscription or delete existing files.

5. Termination & Deletion of Data

You have full control over your data and can choose to leave KithBox at any time:

• If you delete an album, all metadata is permanently removed from our databases, and the physical media files are permanently deleted and purged from our cloud servers at Bunny.net.
• We reserve the right to suspend or terminate accounts that repeatedly violate these terms or fail to pay subscription fees.

6. Disclaimers & Limitation of Liability

KithBox is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to ensure 100% uptime, safety, and durability of your family media through reliable partners like Bunny.net, we cannot guarantee that the Service will be completely uninterrupted or error-free.

To the maximum extent permitted by law, KithBox and its administrators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of access, or media corruption.
